1. Definitions and Interpretations
(a) Conditions means Our standard terms and conditions set out in this document and any other terms agreed to in writing between You and Us.
(b) Intellectual Property means all intellectual property of cuttingedgekids – Educational Consultant + Toys, which without limitation includes any patent, copyright, design, trade mark, (whether registered or unregistered), software programs (and the source code used to write them), formulas, inventions,
circuit layouts and trade secrets.
(c) Services means the provision of general advice on all aspects of primary education to You by professional teachers employed by the New South Wales Department of Education.
(d) You means You and Your business organisation, including any of its employees, agents and representatives.
(e) We or Us or Our refers to cuttingedgekids – Educational Consultant + Toys.
2. Performing the Services
Requesting Our Services
2.1 To request Our Services go to our website http://www.cuttingedgekids.com.au select “Consultancy – Online Consultancy” then complete and submit the details on the screen. We will then contact you via e-mail to either discuss your request, organise a time to discuss your request in-house or provide the Services.
Time to complete Our Services
2.2 A time for delivering the Services will be booked and confirmed by us with You.
2.3 We will use our best endeavours to respond to Your query within 48 hours from receiving it.
2.4 On the date and at time of commencement of the Services and on the time of termination of the service We will record the time and the total time taken to deliver the Services.
3. Payment for Service
3.1 Payment must be received into an account nominated by Us before we will provide Our Services.
3.2 Our Services are charged out at $50 per ½ hour and $100 per hour GST inclusive.
3.3 Payment is non-refundable.
4. Warranty
4.1 We warrant that the Services will be provided using reasonable care and skill and in accordance with any description of the Services on the dates and times set out in Our Conditions.
4.2 Our Services are made available on the understanding that We are not providing specialist advice. Before relying on any of Our advice, You should obtain appropriate specialist advice.
4.3 We do not accept responsibility for the accuracy or completeness of any material contained in this site or any advice provided to you. Additionally, We disclaim all liability to any person relying wholly or partially upon any advice provided by Us, and the consequences of anything, done or omitted to be done.
4.4 You indemnify Us against each claim, action, proceeding, judgment, damage, loss, expense or liability incurred or suffered by, or brought, made or recovered against Us in connection with any breach by you of these terms of use.
5. Intellectual Property
5.1 You must not modify, copy, reproduce, republish, frame, upload to a third party, transmit or distribute in any way Our Intellectual Property except as expressly provided in Our Conditions or as permitted by the Copyright Act.
5.2 Our logo and name are Our trademarks and may not be used in any way by You.
6. Restricted Use
6.1 Unless We agree otherwise in writing, You are provided access to this web site for your personal, non-commercial use.
6.2 You are authorised to print a copy of the advice provided to You for your personal non-commercial use. You may not, without Our written permission on-sell any advice provided to You.
7. Confidentiality and Publicity
7.1 We will not:
(a) release any document or article; or
(b) divulge any information gained in the course of the provisions of Our Services to the media or any person, without the prior written approval of You.
8. Disclaimer
8.1 Use of the internet is neither private nor secure. You acknowledge and accept the risk that any communication to or from this site may be interrupted, used or modified by third parties.
8.2 We do not warrant that access to or use of this site will be uninterrupted or error free or that the site or any material on or accessible through the site is free from errors or viruses, worms, trojan horses, time bomb, cancelbot or other harmful components.
9.General
9.1 These terms and conditions are governed by the laws in force in New South Wales, Australia. you agree to submit to the exclusive jurisdiction of courts of that jurisdiction.
9.2 We are based in New South Wales, Australia. We make no claims that our Services are appropriate for users outside Australia.
